  根据我国法律法规和中华人民共和国海关总署(以下称中方)与土耳其共和国农业和林业部(以下称土方)有关土耳其输华养殖、野生水产品的检验和卫生要求规定,即日起,允许符合以下相关要求的土耳其水产品进口:

  一、检验检疫依据

  (一)《中华人民共和国食品安全法》及其实施条例、《中华人民共和国进出境动植物检疫法》及其实施条例、《中华人民共和国进出口商品检验法》及其实施条例。

  (二)《中华人民共和国进出口食品安全管理办法》《中华人民共和国进口食品境外生产企业注册管理规定》。

  (三)《中华人民共和国海关总署与土耳其共和国农业和林业部关于土耳其输华养殖水产品的检验和卫生要求议定书》(以下简称《养殖水产品议定书》)和《中华人民共和国海关总署与土耳其共和国农业和林业部关于土耳其输华野生水产品的检验和卫生要求议定书》(以下简称《野生水产品议定书》)。

  二、进口产品范围

  (一)养殖水产品。人工养殖的、供人类食用的水生动物产品及其制品、藻类等海洋植物产品及其制品。输华养殖水产品目录见附件。

  (二)野生水产品。供人类食用的野生水生动物产品及其制品、藻类等海洋植物产品及其制品。

  上述水产品不包括《濒危野生动植物种国际贸易公约》(CITES)附录和中国国家重点保护野生动物名录所列物种、活水生动物及水生动植物繁殖材料。

  三、生产企业要求

  (一)向中国出口养殖、野生水产品的生产企业(其中,野生水产品的生产企业包括捕捞船、运输船、加工船、加工厂、独立冷库,下同)和养殖场应获土耳其官方批准并受其有效监督。

  (二)养殖或野生水产品的生产企业的食品安全卫生条件应当符合中方和土方有关食品安全法律法规的要求。

  (三)向中国出口养殖或野生水产品的生产企业应当由土方向中方推荐注册。未经注册,不得向中国出口。

  四、进口产品要求

  土方应确保输华养殖、野生水产品符合以下条件:

  (一)养殖水产品是在土耳其内陆水域、领海和土耳其共和国根据国际法享有开发、管理和保护生物资源的主权权利或管辖权的海域以及国际水域进行养殖的。野生水产品是在土耳其内陆水域、领海和土耳其共和国根据国际法享有开发、管理和保护生物资源的主权权利或管辖权的海域以及国际水域进行捕捞的。

  (四)所有输华养殖、野生水产品经主管当局检验检疫,是卫生的、安全的,适合人类食用,未发现任何传染病和寄生虫病的病理指征,未发现《名录》中列明的和WOAH规定的必须通报的水生动物疫病。

  (五)养殖或捕捞、生产加工、包装、储存、运输、中转和出口等全过程均符合双方相关养殖或野生水产品卫生要求和可追溯要求,同时符合冷链的相关安全卫生要求。

  五、证书要求

  向中国出口的每批或每一集装箱养殖或野生水产品应至少随附一份正本卫生证书,证明该批产品符合中国和土耳其食品安全相关法律法规及《养殖水产品议定书》或《野生水产品议定书》的有关规定。土方应在卫生证书上完整填写养殖或捕捞生产加工、包装、存储、运输、中转和出口等全过程中涉及的生产企业信息。

  证书至少用中文和英文印制(填写证书时英文为必选语言)。证书的格式、内容须事先获得双方认可。土方应及时将证书样本、官方签发机构印章和签字官员笔迹提供给中方备案。如证书样本的内容和格式、官方签发机构印章和签字官员笔迹有变更,土方应至少在生效前一个月向中方备案。

  六、其他要求

  中国海关对输华水产品实施进口检验检疫。对于不合格产品,将依照中国法律法规实施退回、销毁或其他处理。对发生严重问题或多次发生不合格问题的生产企业,中方可采取加强检验检疫或暂停进口等措施。

I. Basis for Inspection and Quarantine
(1) Food Safety Law of the People's Republic of China and its implementation regulations; Law of the People's Republic of China on the Entry and Exit Animal and Plant Quarantine and its implementation regulations; Law of the People's Republic of China on Import and Export Commodity Inspection and its implementation regulations.
(2) Measures for the Administration of the Safety of Imported and Exported Food; Provisions on the Registration and Administration of Overseas Manufacturers of Imported Food.
(3) Protocol between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture and Forestry of the Republic of Turkey on Inspection and Hygiene Requirements for Cultured Aquatic Products from Turkey to China (hereinafter referred to as the "Cultured Aquatic Products Protocol") and Protocol between the General Administration of Customs of the People's Republic of China and the Ministry of Agriculture and Forestry of the Republic of Turkey on Inspection and Hygiene Requirements for Wild Aquatic Products from Turkey to China (hereinafter referred to as the "Wild Aquatic Products Protocol").

II. Scope of Imported Products
(1) Cultured Aquatic Products. Artificially cultured, edible aquatic animal products and their products, algae, and other marine plant products and their products. The catalogue of cultured aquatic products for export to China is provided in the attachment.
(2) Wild Aquatic Products. Edible wild aquatic animal products and their products, algae, and other marine plant products and their products.
The above-mentioned aquatic products do not include species listed in the Appendices of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) and China's List of State Key Protected Wild Animals, live aquatic animals, and aquatic animal and plant breeding materials.

III. Requirements for Production Enterprises
(1) Production enterprises (including, for wild aquatic products, fishing vessels, transport vessels, processing vessels, processing plants, independent cold storage, the same below) and farms exporting cultured or wild aquatic products to China shall be approved by the Turkish official authority and subject to its effective supervision.
(2) The food safety and hygiene conditions of production enterprises for cultured or wild aquatic products shall comply with relevant food safety laws and regulations of the Chinese and Turkish sides.
(3) Production enterprises exporting cultured or wild aquatic products to China shall be recommended for registration by the Turkish side to the Chinese side. Without registration, they are not permitted to export to China.

IV. Requirements for Imported Products
The Turkish side shall ensure that cultured and wild aquatic products for export to China meet the following conditions:
(1) Cultured aquatic products are cultured in Turkey's inland waters, territorial seas, and waters over which the Republic of Turkey enjoys sovereign rights or jurisdiction for exploring, managing, and protecting biological resources under international law, as well as in international waters. Wild aquatic products are harvested in Turkey's inland waters, territorial seas, and waters over which the Republic of Turkey enjoys sovereign rights or jurisdiction for exploring, managing, and protecting biological resources under international law, as well as in international waters.
(2) Neither the raw materials nor the products have experienced any of the following issues:
1. The occurrence in Turkey of aquatic animal diseases listed in the List of Quarantinable Animal Diseases for Animals Imported into the People's Republic of China (hereinafter referred to as the "List") and those compulsorily notifiable by the World Organisation for Animal Health (WOAH) related to products under the Cultured Aquatic Products Protocol or Wild Aquatic Products Protocol, causing cultured or wild aquatic products for export to China to be or likely to be infected.
2. The occurrence in Turkey of any major food safety incidents that have affected or may affect cultured or wild aquatic products for export to China.
3. Cultured or wild aquatic products already exported or intended for export to China by the Turkish side have seriously violated Chinese and Turkish laws and regulations or the provisions of the Cultured Aquatic Products Protocol or Wild Aquatic Products Protocol.
4. Production enterprises have experienced major public health incidents, such as employees contracting major infectious diseases, which have contaminated or may contaminate cultured or wild aquatic products for export to China, their packaging, or means of transport.

(5) The entire process, including cultivation or harvesting, production and processing, packaging, storage, transport, transit, and export, complies with relevant hygiene and traceability requirements for cultured or wild aquatic products of both sides, and also complies with relevant cold chain safety and hygiene requirements.

V. Certificate Requirements
Each batch or each container of cultured or wild aquatic products exported to China shall be accompanied by at least one original Sanitary Certificate, proving that the batch complies with Chinese and Turkish food safety-related laws and regulations and the relevant provisions of the Cultured Aquatic Products Protocol or Wild Aquatic Products Protocol. The Turkish side shall complete all information on the Sanitary Certificate regarding production enterprises involved in the entire process, including cultivation or harvesting, production and processing, packaging, storage, transport, transit, and export.
Certificates shall be printed in at least Chinese and English (English is mandatory when filling out the certificate). The format and content of the certificate must be recognized by both sides in advance. The Turkish side shall promptly provide the certificate sample, official issuing authority stamp, and signature specimen of the signing officer to the Chinese side for filing. If the content and format of the certificate sample, official issuing authority stamp, or signature specimen change, the Turkish side shall file with the Chinese side at least one month before the changes take effect.

VI. Other Requirements
China Customs shall implement import inspection and quarantine on aquatic products for export to China. For non-compliant products, return, destruction, or other measures will be taken in accordance with Chinese laws and regulations. For production enterprises with serious problems or repeated non-compliance issues, the Chinese side may take measures such as enhanced inspection and quarantine or suspension of import.
