根据我国法律法规和中华人民共和国海关总署(以下称中方)与西班牙王国农业、渔业和食品部(以下称西方)关于西班牙饲用水生动物蛋白检疫和卫生要求的规定,即日起,允许符合以下要求的产品进口。
一、检验检疫依据
(一)《中华人民共和国生物安全法》;
(二)《中华人民共和国进出境动植物检疫法》及其实施条例;
(三)《进出口饲料和饲料添加剂检验检疫监督管理办法》;
(四)《中华人民共和国海关总署与西班牙王国农业、渔业和食品部关于西班牙饲用鱼粉、鱼油等水生动物蛋白及油脂输华检疫和卫生要求议定书》(以下简称《议定书》)。
二、允许进口产品范围
本公告允许进口的产品范围包括饲用鱼粉、鱼油等水生动物蛋白及油脂,含水生动物(水生哺乳动物除外)及其加工过程中产生的副产品制成的动物源性饲料。
三、生产企业要求
(一)实施危害分析与关键控制点(HACCP)质量管理体系或按照HACCP理念建立质量管理体系,制定并有效执行产品召回和追溯制度;
(二)在西方有效监督下,符合西方相关法律法规要求;
(三)由西方向中方推荐,获得中方注册登记;企业注册有效期为5年,有效期届满前6个月可向中方申请再延期5年。
四、原料要求
(一)来自于合法捕捞的野生水生动物、养殖水生动物(不包括水生哺乳动物),或供人类消费水产品加工厂的副产品;
(二)不使用因病死亡的水生动物,为疫病防控扑杀的水生动物,以及死因不明的水生动物;
(三)不含任何非水生动物源性成分。
五、生产加工要求
(一)经过中心温度不低于85ºC,持续时间不少于15分钟的热处理,或者中方认可的其他等效加工方式;
(二)生产过程没有添加中方和西方相关法律法规禁止使用的来源不明动物源性成分、非水生动物源性成分及禁用物质;
(三)生产过程中和生产后采取有效措施避免污染。
六、安全卫生要求
(一)产品允许在西班牙境内自由销售;
(二)产品不含有危害动物健康的有毒有害物质,并符合中国的饲料安全卫生标准;
(三)非世界动物卫生组织(WOAH)认可的牛海绵状脑病(BSE)风险可忽略国家或地区向中国出口饲用鱼粉、鱼油等水生动物蛋白及油脂,须经官方主管部门认可的实验室采用聚合酶链式反应(PCR)方法或中方认可的其他方法检测反刍动物源性成分,结果为阴性(输出产品的反刍动物DNA检测限为0.1%);
(四)产品出口前,经官方主管部门随机抽样检测,结果符合以下要求:
1.沙门氏菌:25克产品中未检出:n=5, c=0,m=0,M=0;
2.肠杆菌:1克样品中不超过300:n=5, c=2, m=10,M=300;
其中:
n-检验的样品数;
m-细菌数的最小值(阈值);如果所有样品中细菌数都没有超过m,该结果为合格;
M-细菌数的最大值;如果有1个或多个样品中细菌数等于或大于M,该结果为不合格;

九、进境检验检疫要求
(一)证单核查。
1.核查是否来自注册登记企业;
2.核查卫生证书是否真实有效。
(二)货物检查。
中国海关根据有关法律、行政法规、规章等规定,结合本公告要求,对西班牙输华产品实施检验检疫。经检验检疫合格的,准予进境。
(三)不合格情况处理。
1.有下列情形之一的,作退回或销毁处理:无有效卫生证书的;来自非注册登记西班牙生产企业的;货证不符的;发现土壤、动物尸体、动物排泄物、检疫性有害生物,无法进行有效的检疫处理的;标签不符合标准且无法更正的。
2.经检测发现安全卫生项目不符合中国饲料卫生标准的,作除害、退回或者销毁处理。
3.发现散包、容器破裂的,由货主或代理人负责整理完好,包装破损且有传播动植物疫病风险的,应当对所污染的场地、物品、器具进行检疫处理。
4.对检出严重问题或屡次不合格的企业,中方将采取加强检疫或暂停进口等措施。

II. Scope of Products Permitted for Import

III. Requirements for Production Enterprises
(1) Implement a Hazard Analysis and Critical Control Point (HACCP) quality management system or establish a quality management system based on HACCP principles, and formulate and effectively implement product recall and traceability systems.
(2) Operate under the effective supervision of the Spanish side and comply with relevant Spanish laws and regulations.

(2) No addition during the production process of animal-derived components of unknown origin, non-aquatic animal-derived components, or prohibited substances whose use is forbidden by relevant Chinese and Spanish laws and regulations.
(3) Effective measures are taken during and after production to avoid contamination.
VI. Safety and Hygiene Requirements
(1) The product is permitted for free sale within Spain.
(2) The product does not contain toxic or harmful substances that endanger animal health and complies with China's feed safety and hygiene standards.
