根据我国相关法律法规和中华人民共和国海关总署(以下称中方)与法兰西共和国农业、农食和粮食主权部(以下称法方)关于法国苜蓿草输华卫生与植物卫生要求的规定,即日起,允许符合以下相关要求的法国苜蓿草进口:

  一、检验检疫依据

  (一)《中华人民共和国生物安全法》;

  (二)《中华人民共和国进出境动植物检疫法》及其实施条例;

  (三)《进出口饲料和饲料添加剂检验检疫监督管理办法》;

  (四)《中华人民共和国海关总署与法兰西共和国农业、农食和粮食主权部关于法国苜蓿草输华卫生与植物卫生要求议定书》。

  二、允许进境商品名称

  本公告中的苜蓿草(Medicago sativa L.)是指在法国境内种植,经高温脱水和压缩处理的苜蓿颗粒或苜蓿草捆。

  三、企业注册

  输华苜蓿草应来自法方考核批准的加工企业。加工企业由法方向中方推荐,由中方实地检查或文件审查通过后予以注册登记,在海关总署网站上公布并动态更新。

  四、关注的有害生物

  输华苜蓿草不得携带以下中方关注的有害生物:

  (一)种植、加工、储存及运输。

  1.法方应加强对种植农场、加工企业的官方控制,实施日常监管。种植农场须实施有效的有害生物综合治理(IPM)措施,以避免和控制中方关注的有害生物发生。加工企业应建立良好的危害分析和关键控制点(HACCP)体系、溯源管理体系并有效运行,或按照其理念实施管理。

  2.加工企业和苜蓿草原料的种植、加工及储存场所应与动物饲养场、牧场等隔离,避免被偶蹄类动物的排泄物、分泌物及其他物质污染。在苜蓿草收割、晾晒及储运期间,应避免混入草根、土壤及其他异物。

  3.加工企业应具备机械干燥设施,烘干工艺应保持170℃、15分钟以上。

  4.加工企业应对原料采购、高温脱水、产品检测等环节实施有效管理,保持加工区及设备清洁,在压缩打捆前采取有效的去杂、去污措施,不得采用金属材质材料打捆包装,确保输华苜蓿草符合以下要求:

  (1)不带中方关注的有害生物和其他活的有害生物;

  (2)不带草根、植物种子以及其他植物残体和异物;

  (3)不带动物粪便、动物尸体、禽类羽毛;

  (4)不带土壤;

  (5)不带未经中方批准的转基因成分;

  (6)中国国家标准《饲料卫生标准》(GB 13078)的相关要求。

  5.装运前的储存设施应符合以下要求:

  (1)具有相对封闭和独立的空间;

  (2)采取有效的防鼠、虫、鸟措施,防止有害生物污染。

  (一)证单核查。

  (二)货物检查。

  根据有关法律、行政法规、规章等规定,结合本公告第四条、第五条,对输华苜蓿草实施检验检疫,合格后准予进境。

  (三)不符合情况处理。

  1.无有效植物检疫证书或卫生证书的,作退回或销毁处理。

  2.来自未经注册登记企业的,作退回或销毁处理。

  3.发现土壤或未经中国官方批准的转基因成分的,作退回或销毁处理。

  4. 发现不符合本公告第五条第(一)款第4项的,按照相关法律法规作除害、退回或销毁处理。经处理合格的,准予进境。

  5. 发现不符合本公告第五条第(一)款第6项的,作补正、退回或销毁处理。

  6.发现其他不符合中国进境动植物检疫要求或不符合中国饲料相关安全卫生标准的,将按照相关法律法规规定处理。

  发现上述不符合情况,中方将向法方通报,并根据违规情况严重程度采取暂停相关加工企业、产区输华资质,甚至暂停苜蓿草输华贸易,直至中方确认问题已得到有效整改。

II. Name of Commodity Permitted for Entry

III. Enterprise Registration
Alfalfa for export to China shall originate from processing enterprises assessed and approved by the French side. V. Product Production and Export Requirements
(1) Cultivation, Processing, Storage, and Transportation.

  1. The French side shall strengthen official control over cultivation farms and processing enterprises and implement daily supervision. Cultivation farms must implement effective Integrated Pest Management (IPM) measures to avoid and control the occurrence of pests of concern to China. Processing enterprises shall establish and effectively operate a sound Hazard Analysis and Critical Control Point (HACCP) system and a traceability management system, or implement management based on these concepts.

  2. Processing enterprises and the sites for cultivation, processing, and storage of alfalfa raw materials shall be isolated from animal farms, pastures, etc., to avoid contamination by excreta, secretions, and other substances from cloven-hoofed animals. During alfalfa harvesting, sun-drying, storage, and transportation, mixing in grass roots, soil, and other foreign matter should be avoided.

  3. Processing enterprises shall possess mechanical drying facilities. The drying process shall maintain a temperature of 170°C for a duration of 15 minutes or more.

  4. Processing enterprises shall implement effective management of raw material procurement, high-temperature dehydration, product testing, and other stages, maintain cleanliness in processing areas and equipment, and take effective impurity and contaminant removal measures before compression and baling. VI. Entry Inspection and Quarantine
(1) Document Verification.

(3) Handling of Non-compliance.

  1. Consignments without a valid Phytosanitary Certificate or Sanitary Certificate shall be returned or destroyed.

  2. Consignments originating from unregistered enterprises shall be returned or destroyed.

  3. If soil or genetically modified components not approved by Chinese authorities are found, the consignment shall be returned or destroyed.

  4. If non-compliance with Item 4 of Paragraph (1), Article V of this announcement is found, the consignment shall be treated, returned, or destroyed in accordance with relevant laws and regulations. Entry is permitted after qualified treatment.

  5. If non-compliance with Item 6 of Paragraph (1), Article V of this announcement is found, the consignment shall be corrected, returned, or destroyed.

  6. Other instances of non-compliance with Chinese entry animal and plant quarantine requirements or Chinese feed-related safety and hygiene standards shall be handled according to relevant laws and regulations.
    Upon discovery of any aforementioned non-compliance, the Chinese side will notify the French side and may, depending on the severity of the violation, take measures such as suspending the export qualification of the relevant processing enterprise or production area, or even suspending the alfalfa trade to China, until the Chinese side confirms that effective corrective actions have been taken.
